Agreement
By accessing or using MendMesh, you agree to be bound by these Terms. Please read them carefully before using the Service.
These Terms of Service ("Terms") govern your access to and use of the MendMesh platform, website, and any associated services (collectively, the "Service"), provided by MendMesh ("we", "us", or "our").
If you are accepting these Terms on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation, and references to "you" in these Terms shall refer to that organisation.
If you do not agree to these Terms, you must not access or use the Service.
The Service
MendMesh is a vulnerability workflow orchestration platform that ingests security findings from connected scanners, assigns ownership to engineering teams, groups and deduplicates findings, creates tickets in project management tools, and tracks SLA compliance.
The Service is currently in early access. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with reasonable notice where practicable. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
We may introduce new features, impose limits on certain features, or restrict access to parts of the Service from time to time without notice.
Accounts
To access the Service, you must register for an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Keep your credentials confidential and not share them with any third party
- Notify us immediately at security@mendmesh.io if you suspect any unauthorised access to your account
- Accept responsibility for all activity that occurs under your account
We reserve the right to refuse registration, suspend, or terminate accounts at our discretion, including in cases of suspected misuse or violation of these Terms.
Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:
- Use the Service in any way that violates any applicable law or regulation
- Attempt to gain unauthorised access to any part of the Service or its infrastructure
- Use the Service to transmit malware, viruses, or any other malicious code
- Reverse engineer, decompile, or disassemble any part of the Service
- Scrape, crawl, or use automated means to access the Service without our prior written consent
- Use the Service in a manner that could damage, disable, overburden, or impair our systems
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity
- Attempt to probe, scan, or test the vulnerability of MendMesh systems without authorisation
- Resell or sublicense access to the Service without our prior written consent
Your Data
You retain ownership of all data you upload to or generate through the Service ("Customer Data"). By using the Service, you grant us a limited licence to process Customer Data solely to provide and improve the Service on your behalf.
You are responsible for:
- Ensuring you have the right to connect any third-party data sources to the Service
- The accuracy and legality of all Customer Data you provide
- Maintaining appropriate backups of your data
We process Customer Data in accordance with our Privacy Policy. We will not use your vulnerability data for any purpose other than providing the Service to you.
Third-Party Integrations
The Service allows you to connect third-party tools such as Snyk, GitHub, AWS Inspector, Jira, and others. Your use of those services is subject to their own terms of service and privacy policies.
We are not responsible for the availability, accuracy, or conduct of any third-party service. We do not endorse or assume responsibility for any third-party content or services.
You are responsible for ensuring that your use of third-party integrations complies with the applicable terms of those services.
Payment & Billing
The Service is currently in early access and is provided free of charge to waitlist members during this period. Paid plans will be introduced in due course, and we will provide advance notice of pricing before any charges apply.
When paid plans are introduced:
- Fees will be due in advance and are non-refundable except as required by law or as stated in the applicable plan terms
- We reserve the right to change pricing with at least 30 days' notice
- Failure to pay may result in suspension or termination of your account
Intellectual Property
The Service, including all software, designs, text, graphics, and other content created by us, is owned by MendMesh and protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any right, title, or interest in or to the Service beyond the limited right to use it as described herein.
You must not remove or alter any proprietary notices or labels on the Service.
Any feedback, suggestions, or ideas you provide to us may be used by us freely without any obligation to you.
Confidentiality
Each party may have access to confidential information of the other party. Both parties agree to:
- Keep confidential information secret and not disclose it to any third party without prior written consent
- Use confidential information only for the purpose of performing obligations under these Terms
- Take reasonable steps to protect confidential information from unauthorised disclosure
This obligation does not apply to information that is or becomes publicly known through no fault of the receiving party, is independently developed, or is required to be disclosed by law.
Warranties & Disclaimers
We warrant that we will provide the Service with reasonable skill and care. We do not warrant that:
- The Service will be uninterrupted, error-free, or free of viruses
- The Service will meet all of your specific requirements
- Results obtained from the Service will be accurate or reliable
The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Nothing in these Terms affects any statutory rights that cannot be excluded or limited under applicable law.
Limitation of Liability
To the maximum extent permitted by applicable law, MendMesh shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.
Our total aggregate liability to you for any claims arising under or in connection with these Terms shall not exceed the greater of (a) the amount you paid to us in the 12 months preceding the claim, or (b) £100.
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.
Termination
Either party may terminate these Terms at any time. You may terminate by closing your account. We may terminate or suspend your access to the Service immediately, without prior notice, if you breach these Terms or if we are required to do so by law.
Upon termination:
- Your right to access and use the Service will cease immediately
- We will delete or anonymise your Customer Data within 30 days, unless required by law to retain it
- Provisions of these Terms that by their nature should survive termination shall do so, including IP, confidentiality, disclaimers, and limitation of liability clauses
Governing Law
These Terms are governed by and construed in accordance with the laws of Scotland. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the Scottish courts.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by email (if you have an account) or by posting a prominent notice on this website at least 14 days before the changes take effect.
Your continued use of the Service after the effective date of updated Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service before the effective date.
